Kazakhstan Oil Field Deal Settled

An agreement between Kazakhstan and a consortium of companies ? including BG Group and Eni ? involved in the country's Karachaganak field became effective on Thursday after six months of wrangling over the details.

The deal ? originally signed on Dec. 14 2011 ? settles a dispute more than two years old between the consortium and the Kazakhstan government, with the partners now allowed to recover costs before the government takes its share of the hydrocarbon revenues.

?

It sees the entry of the Kazakh state company KazMunaiGaz, which gets a 10-percent stake issued pro rate by the current partners. Meanwhile KMG will provide a pipeline with the capacity to transport up to two millions tons of liquids a year.

?

"KazMunaiGaz's entrance represents a significant step forward towards strengthening the cooperation between the parties involved in the consortium. In the interim the companies have already started preparatory activities to support future development of the field, which is expected to yield a substantial increase in current production of liquids and gas," said a statement issued by Eni.

BG Group Chief Executive Sir Frank Chapman commented in a BG Group statement:

"We welcome the Republic of Kazakhstan and KMG into the Karachaganak contracting companies group and look forward to working with all of our partners to capture the significant remaining potential of the giant Karachaganak field."

Karachaganak is a giant liquid and gas field with recoverable reserves of five billion barrels of oil equivalent. In 2011, production at the Karachaganak field averaged 239,000 barrels per day of liquids and 784 million cubic feet of gas per day of natural gas.

Microsoft Targets Spotify, iTunes Via Xbox Music

Microsoft is reportedly planning an expansive Xbox streaming music feature, with download, streaming, and online storage functions similar to iTunes and Spotify.

As reported by Bloomberg, Microsoft is in talks with Universal Music Group, Warner Music Group, Sony, and EMI.

The streaming option would be available on a monthly or annual basis, while saved content would be available via the cloud on various devices, Bloomberg said.

Microsoft announced plans for a new Xbox 360 music service at the E3 conference earlier this month, but released few details about what that service would entail. Bloomberg said the company had not yet secured label deals.

On its Zune website, Microsoft said it will be "using our expertise from Zune to launch a brand-new music service under the Xbox Music brand, [which] will bring you a world-class music library, and great new ways to enjoy, share and discover new music."

Microsoft retired the Zune last year. Xbox Music will be available on Xbox 360, Windows Phones, and Windows 8 PCs and tablets, which are not expected to debut until the fall.

A Microsoft spokeswoman declined to comment on the report.

Rumors of a music service began circulating in April.

Multiple mergers generate ultraluminous infrared galaxy

ScienceDaily (June 29, 2012) ? First discovered from the Infrared Astronomical Satellite's (IRAS) all-sky survey in the mid-1980s, ultraluminous infrared galaxies (ULIRGs) are the most luminous class of galaxies in the relatively near or local Universe. Most of their energy output is in the infrared, suggesting that they contain a large amount of dust, an indication of immense star formation.

Astronomers have proposed different scenarios for the development of ULIRGs. Since ULIRGs' huge infrared luminosities (1012 Lsun), powered mostly by a large number of massive stars, are comparable to the high luminosity of quasars, the brightest class of active galactic nuclei, a 1988 scenario (Sanders, D. B., et al. 1988, ApJ, 325, 74)? proposed that ULIRGs were an intermediate phase in the evolution of quasars after a merger. Another scenario proposed by Professor Taniguchi and his associate in 1998 (Taniguchi, Y., & Shioya, Y. 1998, ApJ, 501, L167) hypothesized that multiple mergers among several galaxies explained the observational properties.

However, a number of questions remained unanswered:

1) How many galaxies were merged into one? and

2) Which types of galaxies were merged into one? Since then, explanations for the origins of ULIRGs have remained controversial.

The current team conducted research to help answer these questions and to propose a plausible, data-based explanation for the origin of ULIRGs.

The team made detailed optical imaging observations of Arp 220 using FOCAS (Faint Object Camera and Spectrograph) on the Subaru Telescope and the LRIS (Low Resolution Imaging Spectometer) on the Keck II Telescope. The new imaging data revealed a spectacular pair of tidal tails extending more than 50,000 light years. Intermediate-mass stars (with masses a few to several times that of the Sun), the remains of intense star formation events called "starbursts," dominate the composition of the tidal tails. The presence of an H? absorption line led to the first detection of these features. Dr. Kazuya Matsubayashi said, "I was very surprised when I found these H? absorption features in the two tidal tails."

What could explain these surprising features? A merger between two galaxies is necessary to cause a starburst in a merging system. Therefore, two post-starburst galaxies could have produced the two long tidal tails. However, four galaxies are needed to generate the two post-starburst galaxies. The post-starburst tidal tails revealed by the new observations suggest a new scenario for the merging history in Arp 220. The team suggests that the two observed tidal tails in Arp 220 need a merger between two advanced (i.e., post-starburst) merger remnants. In sum, four spiral galaxies are necessary to explain the observed post-starburst tidal tails in Arp 220. They conclude that Arp 220 comes from a multiple merger that includes at least four galaxies, not from a typical merger. The team thinks that this conclusion about Arp 220 can be applied to other galaxy groups.

There are a significant number of compact groups of galaxies in the Universe that could lead to multiple mergers. Professor Taniguchi noted, "Some of such compact groups have already merged into one. They are the ULIRGs observed to date." Some galaxies are associated together in a single gravitationally-bound group, and they will inevitably merge into one galaxy within several billion years.

Although ULIRGs are thought to evolve into quasars and then into giant early-type galaxies, future considerations of the evolution of galaxies will need to take into account the impact of multiple mergers, not just major mergers between two galaxies. Professor Taniguchi applied this principle to the fate of our Milky Way Galaxy: "Very recently, NASA announced that our Milky Way Galaxy will merge with the Andromeda Galaxy (M31) into a giant elliptical galaxy within several billion years. Please don't worry. That would only be a merger between two galaxies, so our Milky Way will not evolve into a ULIRG."

Linens retailer headed to hall of fame

It's been quite a week for Bob Ianson.

The co-owner of Heirloom Linens in Broadmead Village celebrated the 17th anniversary of the business with his wife, Joan. The couple's daughter delivered their first grandchild. The business donated $4,000 to Victoria Hospice through its annual garage sale event.

And now Ianson is being inducted into the Canadian Retail Hall of Fame.

"I haven't had time to catch my breath," Ianson said.

Ianson was one of eight independent retailers from across Canada to receive the Retail Council of Canada's highest honour.

Normally reserved for founders and CEOs of big corporate stores, this year's induction marks a significant shift to honour small businesses which, when combined, are some of the biggest economic generators and employers in Canada.

The Retail Council and several small business organizations in Canada, including Shelf Space in B.C. and Alberta, are in the process of merging. Ianson and the other inductees were part of a task force formed to study the merger on behalf of independent businesses.

"The Retail Council has usually focused its attention on the big players and larger stores, but they are seeing the importance of the smaller independents," said Ianson.

"It's a huge honour to get into the council's hall of fame," he added.

Ianson, 57, has spent nearly 40 years in retail - all of it in the bed and bath sector.

He joined Woodward's in 1975 at Mayfair Shopping Centre, working his way up the corporate chain to a buyer with transfers to Vancouver and then Calgary.

With the demise of Woodward's, Ianson was headhunted by Seattle-based Pacific Linens and helped the company set up 10 stores in Canada. After Pacific Linens ran into financial difficulties, Ianson and wife Joan made the decision to go into business for themselves and opened Heirloom Linens in Broadmead Village. "I had enough of companies going broke," said Ianson. "I said at the time 'I could probably do that myself.' "

They opened Heirloom Linens on June 25, 1995, and quickly earned a reputation for quality goods and topnotch service. Their slogan - It Only Sounds Expensive - was testament to the couple's strong buying channels and loyal following.

"We've always treated our customers well" through quality products and service, said Ianson. "Staff have a broad product knowledge and our return policy is like that of the big stores. If you don't like it when you get it home or made a wrong measurement for sheets, bring it back."

Returned items are resold at Heirloom Linen's annual garage sale fundraising event.

This month, the company turned over $4,000 to the Victoria Hospice. Last year, more than $7,000 was raised for Jeneece Place for visiting families of children needing medical care at Victoria General Hospital.

"We enjoy the business and we enjoy satisfied customers," said Ianson, who celebrates his 35th anniversary with Joan this year.

"On behalf of the retail industry we are proud to honour this outstanding group of retailers for their vision and commitment to entrepreneurship," Diane Brisebois, president and CEO of the Retail Council, said in a statement. "As members of the council's Independent Retailer Task Force, this group enabled us to chart a course that, at its core, focused on providing community involvement, leadership development and lifelong learning opportunities for independent retailers and their employees across Canada."

Glencore proposes changes to Xstrata deal

(AP) ? Commodities trader Glencore International said Wednesday that it is considering changes in incentives for senior employees of Xstrata as a shareholder revolt over its proposed takeover of the mining company gathered steam.

The possible revision of the offer comes barely two weeks ahead of a shareholders vote on the deal and followed a demand by a Qatari investment fund for better terms for its 10 percent stake in Xstrata. It wants 3.25 new Glencore shares for each Xstrata share, significantly more than the 2.8 shares currently on offer.

The Financial Times reported Wednesday that the Qatari demand means that holders of about a quarter of Xstrata shares are opposed to the terms, enough to block the deal.

"There is now a material risk that the merger could fail with both management teams adamant that the current terms are fair and had only been agreed after extensive negotiations," said Myles Allsop, analyst at UBS.

Glencore shares were down 3.8 percent at 291 pence in morning trading in London, while Xstrata's share price fell 1.5 percent to 774 pence.

One aspect some shareholders have raised objections to relates to the retention provisions in the deal. In particular, concerns have been raised over a three-year, $45 million deal for Xstrata's chief executive Mick Davis, who is in line to become chief executive of the merged company.

In all, the deal calls for 73 senior employees of Xstrata to share in 173 million pounds of incentives to remain in their jobs.

Glencore said it had received a revised proposal from Xstrata "and will make a further announcement when appropriate."

When the deal was announced in February, two big fund managers ? Standard Life Investments and Schroder Investment Management ? said Glencore's offer undervalued Xstrata.

The Association of British Insurers also opposes the retention provisions.

Glencore, which has scheduled a general meeting of shareholders for July 11, already holds a 34 percent stake in the mining company. Xstrata shareholders are to vote on July 12.

Qatar Holding said the revised terms it is seeking "would provide a more appropriate distribution of benefits of the merger whilst properly recognizing the intrinsic stand-alone value of Xstrata."

Qatar Holding, like most Gulf sovereign investors, is not known for shareholder activism. But its decision to rapidly amass a stake in Xstrata in the past months suggested it wanted a bigger voice in the combined company, if not the merger process itself.

Many of its most prominent investments are in Europe. They include London's Harrods department store and stakes in Barclays PLC, Credit Suisse Group, Volkswagen AG, London Stock Exchange Group and French luxury conglomerate LVMH Moet Hennessy Louis Vuitton.

Qatar Holding has increasingly shown an interest in investing in natural resource businesses. Besides the Xstrata holding, it has been building stakes in European energy companies such as French oil giant Total SA, and last year invested in gold miner European Goldfields.

    Celanese Unveils Sunsation Sweetener ? Analyst Blog ...

    Celanese Corporation?s (CE) sweetener and preservative business Nutrinova unveiled a new Sunsation platform that will help food and beverage manufacturers to develop products that have zero calories.

    Sunsation Sunett SL, the first product in the Sunsation basket, is a sweetener system for zero or low calorie food and beverage products. This product can be used in a broad range of foods and beverages including carbonated and energy drinks, cocktail mixers and powdered drink mixes, yogurt and other dairy products. It can also be used in juices, lemonade and punches.

    Nutrinova introduced the Sunsation platform to develop the drop-in sweetener solutions that address consumer trends and needs. The products used by the company in the platform have been approved for use in food and beverage applications in most places.? International sensory analysis company ISI also confirmed that Sunsation Sunett SL considerably adds sweetness to sugar-reduced and sugar-free products.

    Nutrinova is a division of Celanese and is part of its Consumer Specialties division. In April 2012, Celanese released its first-quarter 2012 financial results. The Consumer Specialties division posted sales of $264 million in the quarter.

    During the quarter, Celanese reported adjusted earnings (excluding one-time charges and gains) of 72 cents per share, down from 96 cents a year ago. The profit was below the Zacks Consensus Estimate of 77 cents per share. However, profit, as reported, jumped 28.9% year over year to $183 million (or $1.15 per share).

    Sales for the quarter went up 3% to $1,633 million, exceeding the Zacks Consensus Estimate of $1,616 million. The growth was driven by higher volumes and pricing in the company?s acetyl intermediates and industrial specialties divisions. However, higher costs and weak demand in Europe led to a decline in operating profit by 91.8% to $98 million during the quarter.

    Celanese, which competes with BASF SE (BASFY) and Methanex Corporation (MEOH), currently retains a Zacks #4 Rank, reflecting a short-term (1 to 3 months) Sell rating.

    Hacked eHarmony passwords analyzed for holes

    It makes sense that users of an online matchmaking?service would use the word "love" in a password, ?but it's not really the best choice.?A?recent analysis of 1.5 million hacked eHarmony passwords found that "love" was the most "common word in passwords" used by the service's?subscribers, with "dog" not far behind.

    "While the psychological meanings of these passwords are for the medical profession to decide, the security ramifications are clear," wrote Mike Kelly, security analyst for Trustwave, a security company that analyzed the passwords, hacked in a recent breach that also happened to users of LinkedIn and Last.fm Internet radio earlier this month.

    "Perhaps most telling," Kelly wrote, was that the analysis "also revealed more than 99 percent of the passwords used had no special characters," such as "!" or "$," something that security experts?often?recommend including in?passwords.

    The good news? "Password," often the most common word in passwords, "was only found in 240 passwords," Kelly wrote. " 'Love' was found most often of all the words we checked, which is not surprising due to the fact that these are passwords from eHarmony users.? Also interesting to us, was that we found 'dog' more than twice as often as we found 'God.' ?Would that hold true if this were a Christianmingle.com dump?"

    Trustwave, in its blog posting, also took eHarmony to task for not using what it deemed to be?a secure?enough format for users'?password storage.

    A spokesperson for the matchmaking site told msnbc.com that eHarmony could not comment on Trustwave's findings.

    "The security of our users is of the utmost importance to us," she said. But, "due to our ongoing investigation and cooperation with law enforcement authorities, we cannot comment on these specific points."

    Trustwave said among the most "interesting" base words in eHarmony passwords it found were, in this order: Love, dog, 1234, luv, sex, God, angel, lover, 123456, Jesus, date, harmony, eHarmony, forever and ? yep, "password."

    "We found it interesting that we saw the Top 100 dogs names more often than the top 100 baby girl names" in passwords,? Kelly wrote. "Also, that National Football League teams were seen less than National Hockey League teams. Does this say anything about eHarmony demographics?"

    Overall, while Trustwave said it saw "many patterns we expected, we also saw many more that surprised us." Wrote Kelly:

    The eHarmony dump is just further proof that organizations need to not only store passwords in stronger, salted formats than was previously acceptable, but also need to enforce stronger case-sensitive password policies.? Users, as a whole, still do not understand the need for strong passwords, and will continue to set passwords that meet only the minimum requirements.

    Ex-cruise worker files lawsuit against Travolta

    LOS ANGELES (AP) ? A former cruise line worker has filed a federal lawsuit in Los Angeles against John Travolta, accusing the "Pulp Fiction" star of embracing him naked after complaining about neck pain.

    The lawsuit was filed June 21 by Fabian Zanzi and seeks unspecified damages.

    Zanzi contends Travolta disrobed and held him against his will during a Caribbean cruise three years ago.

    The actor was accused recently in another federal lawsuit of groping two masseurs. The case quickly unraveled after Travolta's attorney, Martin Singer, discredited one of the anonymous accusers by showing the actor was across the country on the day of one of the alleged incidents.

    Singer did not immediately return a call seeking comment Tuesday from The Associated Press, but earlier, he told City News Service that Zanzi's complaint was "another ludicrous lawsuit with inane claims."

    Google Is Trying To Create A Human Brain - Business Insider

    Here's the latest project from Google's ultra-secret Google X Labs, where Google works on fringe technology projects like self-driving cars and computerized glasses: learning how to find cats in YouTube videos.

    Google X is developing a huge network of computers that are able to learn on their own what is present in a YouTube video through a process called machine learning, John Markoff at the New York Times reports.

    The Google research team, led by a Stanford University computer scientist named Andrew Ng and Google fellow Jeff Dean, networked 16,000 computers and fed them random thumbnail images, each one extracted from 10 million videos on YouTube, the New York Times reports.

    The research began years ago, in an attempt to simulate the human brain, the Times reports.

    By culling millions of YouTube videos and scanning thumbnail images from the videos, the computer cluster was able to determine what a "cat" is on its own, rather than being programmed to find cats in those videos.

    Here was the scientists' reaction, according to the New York Times:

    Currently much commercial machine vision technology is done by having humans ?supervise? the learning process by labeling specific features. In the Google research, the machine was given no help in identifying features.

    ?The idea is that instead of having teams of researchers trying to find out how to find edges, you instead throw a ton of data at the algorithm and you let the data speak and have the software automatically learn from the data,? Dr. Ng said.

    ?We never told it during the training, ?This is a cat,??? said Dr. Dean, who originally helped Google design the software that lets it easily break programs into many tasks that can be computed simultaneously. ?It basically invented the concept of a cat. We probably have other ones that are side views of cats.?

    The Google brain assembled a dreamlike digital image of a cat by employing a hierarchy of memory locations to successively cull out general features after being exposed to millions of images. The scientists said, however, that it appeared they had developed a cybernetic cousin to what takes place in the brain?s visual cortex.

    >> politicians you see here, to court watchers, are weighing in on this big decision. there is no clear consensus on a so-called winner. politico writes the decision could potentially anger latinos in a twhat could, quote, give president obama an added boost from hispanic voters in november. that's one perspective. raul reyes , usa columnist and attorney general of south carolina , alan wilson , whose state is looking at something similar to what we're discussing out of arizona . nationally syndicated radio talk show host michael smerconish . three provisions struck down, the most controversial upheld. jan brewer says it is vindication, despite the fact that not every republican even sees this as vindication of this law. what do you say, michael? you're an attorney here.

    >> i think all the politicians' glasses are half full and they could very easily be viewed as half empty , including hers, because three-quarters of it was struck down as you point out. and with regard to the -- as she puts it, the key provision of 1070 , the court left open the opportunity to strike it down when implemented. as i read this decision, it is the court saying, we can't preclude it from being implemented where on its face, on its surface it says race and national origin won't be taken into consideration, but let's see how it is implemented and they left that door open.

    >> raul , let me play what jose diaz -balart had to say on msnbc this morning, this is more about latinos in arizona . let me play jose and get your thoughts on it.

    >> okay.

    >> there is a whole issue of people that may look brown, and can be asked about their papers and if they're citizens, but don't have some passport, because what do we as american citizens carry with us on a daily basis to prove that we were born in the united states of america ? what document? there is no national i.d.

    >> so obviously jose brings up a point, this opens a floodgate for perhaps litigation from people who believe that they have been racially profiled . jan brewer says her state is implemented rules and measures to make sure that doesn't happen. do you believe that statement even on its face?

    >> i'm not sure she can be so confident. one thing that is very important to remember is this whole case that the supreme court was examining, it all turned on the supremacy clause . all of the emotional aspects of this case, racial profiling , civil rights violation, none of that was examined because that's all going to come later. the supreme court specifically left the door open. so one thing i bet everyone on our panel can agree on, there is going to be a flood of cases, challenging this, by hispanic advocacy groups , the aclu. the court has been very reluctant to rule on discrimination or racial profiling in advance. once the law is implemented, we'll see people bringing lawsuits, class actions , different things.

    >> which brings me to the criticism that the president has offered to congress and you hear, for example, governor mitt romney criticizing the president for lack of leadership, it goes under the umbrella that we know there needs to be comprehensive immigration reform in the country and the decision we heard from the supreme court , whether you see it as a win for one side or a loss for the other, we're still in this cloud where we need reform in this country regarding this issue that is not going away with 11 million people plus here.

    >> right. and we're not going to see that soon, tamron. that's really unfortunate. so both sides can point fingers and say it is the other side's fault. we know that's where we are. i think -- i was blown way listening to governor brewer. i want whatever she's having because she's living --

    >> let me tell you, i understand that people will want to hear you say that those who agree, but in her mind, she has a victory on her hands today. she can come and say, the heart, as she put it, which we never heard this was the heart of the legislation, until today, but with that said, she, at this moment, is able to say the heart of the legislation was supported unanimously, joan , by the supreme court , whether you drink the kool-aid, if it is that she is serving, she has this now to, you know, stand upon with this controversial law.

    >> well, it is great. she's a master of spin. i really -- i really hand it to her. this is not a victory for arizona . i think as the other panels have said, going forward it is going to be very interesting to see how they implement the one piece that they are allowed to go forward with. there will be a lot of civil rights complaints about it and it is an -- it is political. you had justice scalia today actually coming out of nowhere, and singling out president obama , slamming president obama for his decision on deporting young people of a couple of weeks ago. this situation has become so partisan, so political, so ugly. i think it is going to get worse before it gets better.

    >> this is the world we live in today. sadly, you and i know that. alan, part of the ruling makes mention of other states following suit at least when it comes to police being able to check status of those they arrest. what does your state stand?

    >> well, actually, i consider this a partial victory for south carolina . i think everybody here is going to concede there are, you know there are partial victories for both sides. it is a mixed bag. but for south carolina , i will agree with governor brewer on this count, that the legal stop provision for law enforcement was a central part of our immigration law . there are only three components of our law that were struck down as being preempted at the district court here in south carolina . the supreme court has addressed those this way. one of them they have struck down. that was the requirement that illegal aliens carry registration card. there was also the illegal harboring and transporting provision of our law, which the court did not directly address. and then there is the law enforcement detention and then the subsequent asking of the person's national status or making the determination which the court unanimously upheld. i consider that a great victory for law enforcement and for law enforcement specifically in south carolina .

    >> is it a great victory for this country?

    >> the national immigration law center, one of the spokespersons says this, regarding arizona . this is not simply about undocumented immigrants. this is about any person who looks or sounds foreign, skin color . this is a throwback to the days of our country when racial profiling and discrimination was with state sanctioned this and is simply unacceptable in 2012 . with the praise that you laid upon arizona and this decision to be able to stop people and check their quote/unquote status here, how do you ensure -- how does arizona ensure this does not fall into racial profiling ? you can send people to sensitivity, you can send to training, but how can you ensure that someone who is a legal citizen of this country is not seen as quote/unquote, foreign or as an alien as you referred and pulled over and profiled here. how do you protect the people here legally who may fit into a quote/unquote suspicious category.

    >> i would like to answer that.

    >> go ahead. i would like to answer that. if you go to the state department , look under the bureau of consular affairs , there is an access manual they put out to all local, state and federal law enforcement which basically strongly recommends and mandates that they actually determine someone's national status pursuant to a lawful detention or stop. you have the state department already promulgating regulations for law enforcement throughout the country that basically ask law enforcement officials at all levels of our government to actually determine someone's national status when stopping them legally for, say, a traffic infraction. it has been going on for years to claim there is racial profiling is ridiculous. we already have the state department putting out these types of regulation ands and manuals for all states to follow. it is absolutely predict us.

    >> is it ridiculous, raul ?

    >> i have to address something about local law enforcement. this law actually puts tremendous pressure on local law enforcement officials in arizona because part of the law that is already in effect that was not even challenged, allows any citizen who believes that the law is not being effectively enforced to sue their local police or sheriff. this opens a tremendous floodgate of potential liability to any citizen who can basically sue the police department and say you're not pursuing the most effective solutions. i think it puts law enforcement in a tough spot. i don't think it is good for local law enforcement.

    >> is it ridiculous as the attorney general --

    >> i think he misses for hispanics, for latino americans, this is the civil rights issue of our time. and, you know, for us to be, if we're in arizona , be worry about whether our elderly relatives have i.d. or whether they're out alone without the proper papers, that is totally un-american and goes against our american values and there will be lawsuits by any number of hispanic advocacy groups .

    >> pete williams noted in his report that obviously this will go on for an extended period of time for the reasons that raul pointed out because of lawsuits. but what is your view on the notion that this is seen as ridiculous, that checking someone's status as the attorney general -- and i'm happy he is on, because obviously south carolina factors into this, michael but legally you've worked with many law enforcement personnel throughout your career.

    >> i think that many law enforcement personnel that i spoke to don't want this responsibility. they're concerned about what training do they have that would allow them to make these sort of determinations, their plates are already full and frankly, it puts them in a front line capacity, it puts them in the role of a customs and border patrol agent, which is not their function traditionally on a local level.

    >> joe, let me go back to --

    >> that's not true.

    >> i'm sorry. go ahead.

    >> that last statement wasn't true. every law enforcement official i talked to in south carolina wants this. i haven't spoken to anyone that i'm aware of that doesn't want this. and if anyone in this panel read south carolina 's law, i would ask you do so. if you read the law, you find someone is stopped for speeding or a broken taillight, the law enforcement official can only hold them for a reasonable time as to make a determination as to what law was broken and if they have a reasonable suspicion they're not here legally, they can then call the ice officials or federal government and they make the determination as to deportation. if you cannot make a determination as to their legal status , you can't verify they're here legally, you must let them go. you can't keep someone just because they don't have a driver's license. that is forbidden by south carolina law. this screaming, the sky is falling and this is racial profiling is a red herring and doesn't address the real issue, which is giving law enforcement the tools they need to do their jobs. which the state department is already allowing.

    >> attorney general , i can say this, i don't know -- and i've not spoken with the people in south carolina , but i personally interviewed law enforcement personnel out of arizona , who were concerned about their role in this, many of which came out against the legislation in arizona . that is a fact. let me bring in joan walsh to talk about the politics of this, joan . we're waiting president obama is set to speak. we should hear his first live remarks on this. governor mitt romney came out with a very vague statement regarding this. he's been criticized already for not taking a hard line . i'm going to pull up his statement here. let's talk about the politics of it first, joan .

    >> sure. well, you know, i mean, i saw his statement. and no one can really parse his statement to know exactly where he stands. every single issue that comes up, tamron, his response is president obama has failed to lead. and just as with the enforcement -- whether he would overturn the president's decision not to deport young people who were brought here illegally last week, he continues to evade responsibility on these questions and talk in vague platitudes. we all would love a comprehensive solution. it is elusive. the president will have certain powers and mitt romney can't really tell us how he would use those powers.

    >> i have the statement, joan . he said governor romney said i believe that each state has the duty and the right to secure our borders and preserve the rule of law, particularly when the federal government has failed to meet its responsibilities. as candidate obama, he promised to present an immigration plan during his first year in office, but four years later, we are still waiting . and that is part of the governor's statement there. with that said, not very specific on what he would like to see on his first day as the ad points out with the economy, for example.

    >> right. and, you know, i think -- i think that the president -- it also ignores the fact that the president, a, can't pass legislation by himself and, b, the other thing that governor brewer completely misrepresented, very controversially, this president has done a lot more to enforce our laws and has deported a lot more people than president bush did, you know, which is a very, very controversial in the latino community. he's been very aggressive on using the tools he has. so this notion he's just letting people wash over the borders and he's not doing anything, he doesn't care, and he could somehow with the stroke of a pen or the wave of a wand pass comprehensive immigration reform is just a misunderstanding in our political system .

    >> attorney general , i want to bring you in. your statement and correct me if i'm wrong, you focus in on what i think is an interesting part of the conversation. businesses and their responsibility in all of this. i grew up in the state of texas . and i went to school with a number of children whose parents were in the country illegally, who were exploited as a workforce in the state of texas , where businesses, many of them donated to different campaigns, seem to escape the eyebrow raising that we get from someone who perhaps is pulled over . you have businesses, the hotel industry , the restaurant industry, that would perhaps in many ways in certain states as you well know be decimated if they had the iron fist of some of the actions taken by lawmakers. with all of that said there seems to be enough blame to go around when you look at congress with the 13% approval rating, attorney general , where there needs to be action here and different states like yours are put in a position to take action that is seen as right and wrong depending open your perspective.

    >> well, first off, i want to say this, our law goes to great lengths to protect people's individual liberties. we go great lengths to protect people from being profiled against and to make sure law enforcement is given the appropriate guidance. all we want to do is support the federal government . for years we have heard they don't have the resources. earlier one of the other persons said that president obama used every resource available to him. that's not entirely accurate because he has local and state law enforcement. they're fighting us every step of the way. we don't want to usurp congress' power under article one, section 8 of the constitution. we just want to help congress enforce those laws. this is not a patch work like a quilt, like the president claims, of different laws around the country. we want to support the federal framework for implementing immigration laws . we want do it at the state level. what is going on now that the federal government , the congress can never, ever again punt this thing saying they don't have the resources necessary to enforce immigration laws . they have the states to help them. it is true, it was said earlier, the supreme court could look s a as an as applied argument. but we have safeguards in our law that will prevent that from happening.

    >> joan , you have the last word on this since the attorney general referred to you.

    >> i don't think you can say the president isn't doing everything he can because he's not using state and local officials. that's a complete misunderstanding of law enforcement and the way our government works. so this president has been as aggressive as he can be with the powers that he has. very controversially with parts of his base.
